Terms and Conditions of Service

1. Definitions

"Online Service" - the website at https://sitandstaysheffield.com, any pages within, any automatic API or automated systems (such as booking, pricing, or availability systems).

"Boarding Service" - a confirmed booking for your dog(s) to stay with us at our property for an agreed period of time, which starts when your dog(s) are dropped off with us and concludes once you have picked them up and exited our property.

2. Boarding Service Terms

You must present the dog to the Boarding Service in a clean and groomed condition and with up-to-date vaccinations, de-flea and de-worming treatments. Vaccination certificates must be produced.

You must supply the necessary dog food and treats for the duration of the Boarding Service. If additional food or treats are required you agree to refund Sit and Stay Sheffield.

You agree that if you instruct Sit and Stay Sheffield to exercise your dog off the lead during the Boarding Service you accept full liability for any loss or damage caused as a result of your dog being off the lead. In the event that your dog is involved in a fight with another person or a dog causing any damage or injury you agree to be responsible for any losses incurred including payment of veterinary fees, legal fees or any medical treatment required.

We are unable to accept bookings for a dog subject to the terms of the Dangerous Dogs Act 1991 or any other dogs with aggression problems towards other dogs and/or people. We do not accept intact male dogs or bitches in season.

Reasonable efforts will be made to contact you in the event of an emergency. However, Sit and Stay Sheffield reserves the right to make decisions regarding your dog's health provided it is at all times acting in the best interests of the dog and on the advice of a veterinary professional. If your dog becomes unwell, has an accident or injures himself/herself or seems to be in any type of pain, we might need to take him/her to a veterinary practice and you agree to be responsible for payment of all the veterinarian fees incurred.

You undertake to make full disclosure of any quality or characteristic which might make your dog not suitable for home boarding, including, but not limited to behavioural or health problems, anti-social behaviour including aggression, incontinence/lack of housetraining or excessive loud barking/whining. Failure on your part to disclose any matter which might render the dog unsuitable for the Boarding Service will be deemed a material omission amounting to a fundamental breach of this agreement. You will also be liable for additional costs if Sit and Stay Sheffield experiences difficulties due to failure to disclose in the booking form any matter that would be accepted as reasonably unsuitable for home boarding.

A deposit of 50% of the total payable amount of the Boarding Service is due at the time of booking. Your booking can only be confirmed when both the deposit and the signed booking form have been received AND following a successful Meet and Greet visit. Sit and Stay Sheffield is not able to keep bookings open for more than 10 days so bookings will be released if not secured with a deposit.

If you cancel your booking within 14 days of the start of the Boarding Service the deposit paid will be fully non-refundable. If cancelled within 15-30 days prior to Boarding Service commencement then 50% of the deposit paid will be refunded. If more than 30 days notice is given then the deposit will be refunded in full. Notification of cancellation must be made in writing to Sit and Stay Sheffield.

If Sit and Stay Sheffield is unable to fulfil a booking, we will use all reasonable endeavours to arrange an introduction to another suitable boarding service. If we are not able to recommend an alternative boarding service, we will refund your booking deposit.

3. General Terms

By accessing the Online Service, contacting us with an enquiry or booking dog boarding services (collectively, the "Service") you are agreeing to be bound by these Terms and Conditions of Service (the "Terms"), all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing the Service. The information or software (collectively, "Content") contained within the Service is protected by applicable copyright and trademark law.

You must be at least 18 years old to use the Online Service. Sit and Stay Sheffield ("Service Provider", "we", "us" or "our") may ask for identification or photographic copies of identification to be provided in order to verify the authenticity of transactions or interactions on the Online Service.

You represent that all information you provide to the Service upon registering, making a booking, amending or cancelling a booking, or in communication with us and at all other times will be true, accurate, current and complete, and you agree to update your information as necessary to maintain its truth and accuracy.

You may not use the Service for any illegal or unauthorised purpose.

You are solely responsible for your conduct and any actions triggered by you when using the Service.

You must not change, modify or alter another website so as to falsely imply that it is associated with the Service or the Service Provider.

You must not interfere with or disrupt the Service or servers or computer networks connected to the Service, including by making unnecessary or unreasonable requests to the Service, transmitting any worms, viruses, spyware, malware or any other code of a malicious or destructive nature. You must not inject code or modify Content that could change how a page is rendered or displayed in a user's browser or device.

You must not use any part of the Service or its Content through unauthorised means, including but not limited to, by using an automated device, bot, crawler or scraper.

Violation of any of these Terms may, in the Service Provider's sole discretion, result in prohibition of access, cancellation of any bookings, appointments or further legal action.

4. Use Licence

a. Permission is granted to temporarily download one copy of the Content from the Online Service for transitory viewing only. This is the grant of a licence, not a transfer of title, and under this licence you may not:

  1. modify or copy the Content;
  2. use the Content for any commercial purpose, or for any public display (commercial or non-commercial) without the Service Provider's express written permission;
  3. attempt to decompile or reverse engineer any Content contained on the Online Service's servers or computers or computer networks;
  4. remove any copyright or any other proprietary notations from the Content; or
  5. transfer the Content to another person or 'mirror' the Content on any other server.

b. This licence shall automatically terminate if you violate any of these restrictions and may be terminated by the Service Provider at any time. Upon termination of your licence, you must destroy any downloaded Content in your possession whether in electronic or printed format.

5. Rights

The Service Provider reserves the right to refuse access to the Service to anyone for any reason at any time.

The Service Provider does not claim ownership of any information that you provide to the Service. Instead, you hereby grant the Service Provider a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide licence to use the information that you provide to the Service, subject to the Service's Privacy Policy.

The Service name and logo are trademarks of the Service Provider, and may not be copied, imitated or used, in whole or in part, without the prior written permission of the Service Provider.

6. Disclaimer

The Content is provided by the Service on an 'as-is' basis. The Service Provider makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, the Service Provider does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Content on its Service or otherwise relating to such Content or on any sites linked to this site.

7. Limitations

In no event shall the Service Provider or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use of, or inability to use the Service or its Content, even if the Service Provider or an authorised representative of the Service Provider has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Accuracy of Content

The Content appearing on the Service could include technical, typographical or photographic errors. The Service Provider does not warrant that any of the Content on its website is accurate, complete or current. The Service Provider may make changes to the Content contained on its Service at any time and without notice. However, the Service Provider does not make any commitment to update the Content.

9. Links

The Service Provider has not reviewed all of the websites linked to its Service and is not responsible for the contents of any such site. The inclusion of any link does not imply endorsement by the Service Provider of the site. Use of any such linked website is at the user's own risk.

10. Modifications

The Service Provider may revise these Terms for its Service at any time and without notice. By using the Service you are agreeing to be bound by the then current version of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
